The Supreme Court ordered the Calcutta High Court to rule on the application first, before proceeding to the merits of the case. The supreme Court on Friday stayed a Calcutta high court judgment denying West Bengal chief minister Mamata Banerjee and state law minister Moloy Ghatak the right to respond to the Central Bureau of Investigation (CBI) appeal for the Narada sting case to be transferred.
Even though the hearing in the case began on May 27, the stated application must include grounds for not filing the affidavit all this time.
The Supreme Court directed the Calcutta High Court to first consider the application before proceeding to the case's merits. On Sunday, CBI will be served with a copy of the application, which will be heard before the high court on Tuesday.
