NIA rejects Sachin Waze's plea for "house arrest" on health grounds
The National Investigation Agency (NIA) said Monday there is "every possibility" that the released assistant police inspector Sachin Waze “will abscond" if his call for house arrest or home care is approved by the court and requires his release. Waze was placed under house arrest for three months by his lawyer Rounak Naik on the grounds that he broke up on April 13.
In response, the NIA said Waze was charged on September 3, the investigation had been suspended and that his house arrest at the time was "is totally against the settled position of law and justice."
In response to Special Prosecutor Sunil Gonsalves, the agency said the Mumbai hospitals associated with Taloja Prison, where Waze was held in connection with the Antilia bombing, aided with all modern facilities to take care". He added that his request was “based on conjectures and surmises’’and that prison authorities could also be heard.
Waze’s case is that he has "undergone a complex cardiac surgery with 5 grafts" adding that "it is medically known fact that post-surgery there is a high likelihood to contract the infection in a non-sterile environment." He said even “TB and skin infection rates’’ are significantly higher in jail and chances of him contracting a post-op infection in jail cannot be ruled out as he is also a "high-risk patient" since he has "severe diabetes" too. He added, "Due to sensationalism involved with the case" even court orders get a "delayed response time" from jail management in medical emergencies due to "red-tapism".
His petition also cited the Bombay Supreme Court order in the Elgar Parishad case, in which Father Varavara Rao was charged with bail six months after he was introduced by his attorney. “there were no doctors at Taloja Central Prison hospital and there were only three Ayurvedic practitioners to look after inmates who were suffering from health issues.’’
The NIA's response shows that Rao's reasons are completely different from Waze's.
The court adjourned Wazes' plea to a hearing on Wednesday.
